Business method patents: Grant appeal dismissed

Last year I discussed Grant v Commissioner of Patents in which the Federal Court dismissed an appeal against the Commissioner of Patents’ decision to refuse to register a patent
application for "a method for structuring a financial transaction, the
purported effect
of which is to protect an individual’s assets (presumably against the
lawful claims of the individual’s creditors)".

An appeal to the Full Federal Court has also now been dismissed.

It said:
It has long been accepted that
"intellectual information", a mathematical algorithm, mere working directions
and a scheme without effect are not patentable. This claim is "intellectual
information", mere working directions and a scheme. It is necessary that there
be some "useful product", some physical phenomenon or effect resulting from the
working of a method for it to be properly the subject of letters patent. That is
missing in this case.

Kim Weatherall comments that the case confirms the trend in Australian case law that …to allow patents for business systems so long as they are implemented via some technical means – eg via computer/database/software.

Click fraud occurs when scammers repeatedly click on ads to cause a rival company to be overcharged.

This report suggests that up to 15% of clicks could be fraudulent.

Turning an idea into a business

Recently I became aware of an Australian technology start-up company that went straight to Silicon Valley for its funding. Whilst it has maintained a base and staff in Australia it has set up another office in California. Does this mean that Australian state and federal governments have failed in their commitment to create a smarter country? Is it impossible to build a successful technology company here?

There are many examples of successful Australian inventions. Australians have created new medicines, machines and technology. So why do Australian inventions end up overseas? Are the Australian investors too cautious?

Hewlett-Packard, Apple and Google were all started in garages. They did not have government assistance. And there are plenty of anecdotes of investors who were offered the chance to invest in these companies but did not.

Perhaps it is just as hard to create a smart  country as it is to pick successful businesses.

In Startups: can we create another Silicon Valley in Queensland? I discuss these issues  and consider what are the essential ingredients required to support the growth of new businesses.
